When you engage Cosmic Animations for our animation services, you agree to the specific terms outlined in your service agreement or project proposal. The services provided will be based on the mutually agreed-upon scope, timeline, and pricing, as detailed in your project contract.

Scope of Work

The scope of work is defined in the specific contract for each project and may vary. This could include:

Custom animation services
Scriptwriting and voice-over
Storyboarding and concept development
Final animated videos (2D/3D)
Revisions and project feedback

The final deliverables will align with the specifications provided in the contract.

Project Timeline and Delivery

We strive for timely delivery of all our animation projects. However, the timeline may change based on the complexity of the project and any additional revisions requested. All delivery dates are estimated and are subject to change based on project requirements.

Changes to Scope

If additional work is required or changes are requested after the initial scope has been agreed upon, Cosmic Animations reserves the right to adjust the project fees and timeline accordingly.

3. Client Responsibilities

Clients are required to provide all necessary materials, including but not limited to:

Script or content for animation (if applicable)
Branding elements (logos, color palettes, fonts)
Any other assets as requested by Cosmic Animations to complete the project

Clients are responsible for ensuring that the content they provide does not infringe on third-party copyrights. Any content provided to Cosmic Animations must be original or properly licensed.

4. Payment Terms

For all projects, payment will be made in accordance with the terms set forth in the project agreement. Payments are typically structured as follows:

Deposit: A percentage of the total project cost is required upfront before work begins.
Balance: The remaining amount is due upon completion or delivery of the final product.

Cosmic Animations accepts payments via various methods, including credit/debit cards, bank transfers, and other payment gateways. All payments are due in the agreed-upon timeframes and are non-refundable once the work has begun.

5. Revisions and Edits

We strive for complete client satisfaction. Revisions are typically included in our service offerings, depending on the agreement. However, the number of revisions and any additional costs will be clarified in the project contract. Cosmic Animations will not be held responsible for any delays resulting from delays in client feedback or approval.

6. Intellectual Property

Upon full payment for services rendered, the intellectual property (IP) rights for the final animated videos will be transferred to the client. Cosmic Animations retains the right to showcase the work as part of our portfolio unless otherwise specified in the contract.

Cosmic Animations retains the right to use parts of the work for marketing, demonstration, and portfolio purposes. All assets, including design elements, animation files, and scripts, provided to the client remain the property of Cosmic Animations until full payment has been received.

7. Confidentiality

We take the confidentiality of your business and project information seriously. We will not disclose any proprietary or sensitive information without your permission unless required by law. Any non-disclosure agreements (NDAs) can be agreed upon and signed prior to starting the project if necessary.

8. Limitation of Liability

Cosmic Animations will not be held liable for any indirect, incidental, or consequential damages resulting from the use of our services or website. Our liability, whether in contract, tort, or otherwise, is limited to the amount paid for the services provided.

9. Website Use

By using Cosmic Animations website, you agree not to:

Use our website for illegal purposes.
Violate any laws, rules, or regulations.
Upload, post, or share any harmful or offensive content.
Attempt to interfere with the operation of our website or its security features.

We reserve the right to restrict access to the website at our discretion if these terms are violated.

10. Termination

Either party may terminate the contract with written notice. In the case of termination by the client, the client remains responsible for payment for services rendered up to that point. Cosmic Animations reserves the right to terminate the agreement if the client violates any terms of the agreement.

11. Force Majeure

Cosmic Animations will not be held liable for any failure to perform due to unforeseen circumstances or causes beyond our reasonable control, including but not limited to natural disasters, acts of terrorism, strikes, or any other circumstances that hinder our ability to complete the project as agreed.

12. Governing Law

These Terms and Conditions are governed by the laws of Perth, Australia. Any disputes arising from these terms will be handled in accordance with Australian law.

13. Privacy Policy
